A Rochester man has been sentenced to prison in connection with the investigation of a deadly drug overdose.

47 year old Demetrious Deal was charged with selling heroin to 39 year old Nicholas Miner, who died last May from an overdose of the drug. Deal was facing a 3rd degree murder charge and 3 felony drug counts. He pleaded guilty to one of the drug charges last month as part of a plea deal and was given an 8 year prison sentence Friday.

He was arrested after officers searched his Kutzky Park area home and found a small amount of heroin. Investigators had received information earlier that Deal was the one who sold some heroin to Miner, who was found dead in his residence earlier that day.

According to the criminal complaint,  investigators talked to a cousin of the victim who said the two wanted to get high on heroin. The cousin says Miner made a cell phone call to someone referred to as  “D-Bo” or “D-Bone” and they later drove to the northwest Walgreen’s store. The cousin says Miner met a man there and bought some heroin. The two then returned to Miner’s residence and shot up the heroin.

Police checked Miner’s cell phone and found a number that was traced to Deal.  During his police interview, Deal admitted Miner had called him but denied selling him any drugs.
