20-year-old Isaac Gutierrez is charged with two counts of second-degree murder and one count of second-degree assault in the death of 24-year-old Osbel Orneals.
The Rochester man is accused of fatally shooting Orneals in the back of the head during a parking dispute at the Crossroads Shopping Center on Feb. 3.
According to the criminal complaint, Gutierrez allegedly shot Ornelas while the victim and Gutierrez's older brother, identified as 26-year-old José Gutierrez Ojeda, were fighting in the parking lot.
The court document says witnesses reported the fight broke out after the victim became upset when Gutierrez Ojeda decided to back into a parking space, which blocked the path Ornelas was taking in his vehicle.
Both brothers were still at the scene when the Rochester Police Department arrived and claimed they were acting in self-defense, the charges say.
Gutierrez Ojeda, has been charged with second-degree assault felony counts of terroristic threats and two counts of aiding an offender after falsely claiming he was the shooter, according to the court document.
His next court appearance is set for next month.
