St. Paul, MN (KROC-AM News) - The Minnesota Supreme Court has refused to hear an Owatonna man's appeal involving his conviction for the murder of a Minneapolis man.

29-year-old Mubarak Musse admitted to a second-degree murder charge last year and was sentenced to almost 22 years in prison. He later appealed his sentence by claiming the judge in the case abused her discretion when she denied his motion for a downward departure from state sentencing guidelines, but the Minnesota Court of Appeals sided with the judge.

State guidelines call for a presumptive sentence of between 261 months and 367 months in prison. Musse's sentence is on the low end of that scale and the pre-sentence investigation report recommended a 306-month prison term. Musse requested a downward departure to only 86 months.

Musse was arrested in March of last year following a fatal shooting outside a Minneapolis market. The deadly shooting was recorded by a surveillance camera outside the business and shows Musse and another man arguing before the Owatonna man pulled out a handgun and opened fire.

The criminal complaint indicated Musse shot the victim multiple times and continued to shoot at him after the man fell to the ground. Minneapolis police investigators later recovered 15 spent shell casings at the crime scene.
