Rochester, MN (KROC-AM News) - A Rochester man accused of being under the influence of drugs when he ran over and killed his girlfriend has been acquitted of the most serious charge he faced.

44-year-old Dewain Siewert was charged with criminal vehicular homicide and DWI in 2019 after testing of a sample of his blood found traces of amphetamine and methamphetamine. According to the criminal complaint, he admitted to smoking some methamphetamine a few hours before the tragic incident on September 17, 2019.

Court records indicate that 39-year-old Emily Jacobsen was looking for her cat when she was run over by a pickup and dragged an unknown distance in an alley near her home. The truck was driven by Siewert, who told police he and Jacobsen were looking for the missing and she was apparently on her hands and knees looking under a boat when she was run over. Jacobsen died from her injuries the following day.

Rather than face a jury, Siewert opted for a court trial, and Olmsted County Judge Joseph Chase was presented with the evidence in the case this week. Late Friday afternoon, Judge Chase returned his verdict and acquitted Siewert of the criminal vehicular homicide charge, but found him guilty of the misdemeanor DWI count. A court filing by the judge seemed to suggest the case revolved around what level of negligence needed to be proved to support a guilty verdict on the felony charge.

Siewert is scheduled to be sentenced for the DWI conviction on December 8.
