Byron, MN (KROC-AM News)- The Olmsted County Sheriff’s Office says deputies arrested a Rochester man on suspicion of DWI after he allegedly walked away from a crash between Rochester and Byron early Sunday morning.

Sheriff’s Captain James Schueller said deputies responded to the report of an overturned 2016 GMC Sierra in the median of Hwy. 14 at County Rd. 3 shortly after 2 a.m. He said deputies found the vehicle empty and began searching the area, fearing the driver had been either ejected or had wandered off after suffering an injury.

A passing motorist then reported seeing a man walking eastbound along 10th Ave. Northeast in Byron. When deputies arrived in Byron they spotted a man identified as 21-year-old Garrido Fabian walking west along a frontage road.

The deputies say Fabian was wearing a T-shirt, had blood on his hand and torn jeans. Schueller said Fabian admitted to crashing his vehicle after drinking four beers.

A preliminary breath test indicated Fabian had a Blood-Alcohol-Content of .19 and a DMT test at the Olmsted County Adult Detention Center measured Fabian’s blood-alcohol level at .13. 

Fabian was evaluated at the scene then released by Byron First Responders. Fabian is awaiting arraignment and Schueller said he could face charges for DWI, driving without a Minnesota driver’s license and driving without insurance.
