The Safeguard American Voter Eligibility (SAVE) America Act (H.R. 7296) passed the U.S. House of Representatives on February 11, 2026. The legislation proposes the first-ever national mandate for both voter registration and in-person voting.

The SAVE America Act proposes the following requirements:

  • Registration: Requires "documentary proof of U.S. citizenship" (e.g., a passport or birth certificate) to register for federal elections.
  • Voting: Mandates presenting a photo ID at the polls.
  • Mail-In Voting: Requires voters to include a copy of their ID when both requesting and submitting a mail-in ballot.

Critics of the act say it would disenfranchise millions of eligible citizens, since an estimated 21 million voting-age citizens lack ready access to a birth certificate or passport.

It would also create significant hurdles for the millions of married women whose current legal names do not match their birth certificates.

Election experts also note that non-citizen voting in federal elections is extremely rare and already illegal, making the new act unnecessary.

What Happens Next With The SAVE America Act?

The SAVE America Act has officially moved to the U.S. Senate for consideration, although a specific date for a Senate floor vote has not yet been scheduled.

However, Majority Leader John Thune has indicated that the bill faces a "shaky future" in the chamber. It requires 60 votes to overcome a filibuster, but Republicans currently hold 53 seats and face opposition from Democrats and some Republicans, such as Senator Lisa Murkowski.

Because of that uncertainty, President Trump has indicated he may issue an executive order to require proof of citizenship for the upcoming midterm elections if the act remains stalled.

Wisconsin DMV Explains Steps To Obtain An ID To Use At The Polls

So, what does all of this mean for the upcoming elections in Wisconsin?

Recently, the Wisconsin Department of Transportation (WisDOT) Division of Motor Vehicles (DMV) explained the steps needed to obtain an ID to show at the polls if the voter does not already have some form of approved ID, such as a Wisconsin driver's license or ID.

It's important to note that a federally compliant REAL ID is not required in the state to vote, and there is no separate "Voter ID" card. However, Wisconsin residents are required to show identification to cast their ballot.

There are many forms of photo ID, which Wisconsinites may already have, that can be used to vote. Anyone voting in person must show the original copy of their photo ID.

Anyone with a valid Wisconsin driver's license or Wisconsin state ID card, or any of the approved documents listed online, already has the photo ID they need for voting purposes.

This includes a student ID issued by an accredited Wisconsin college, university, or technical college. All 2 and 4-year colleges, universities, and technical colleges in the State of Wisconsin System, and accredited, private schools are accepted at the polls.

The address on your ID doesn’t have to be current. And the name on your ID doesn’t need to be an exact match for your name in the poll book. (So, Richards who go by Rich, Bobs who are also Roberts, and Susans with IDs for Sue can still show their acceptable photo ID and receive a ballot.)

Those looking to get their first Wisconsin ID should begin at the DMV's website: wisconsindmv.gov/idcards. You'll see a list of the required documents that are needed to present at a DMV Customer Service Center to obtain identification to show at the polls.

They should then bring the required documents and apply at the nearest DMV. Appointments are available but not required.

There is also a process available to U.S. citizens, free of charge, to obtain a receipt valid to take to the polls for voting if the ID card is not available in time.
