Apple Valley, MN (KROC-AM News) - Prosecutors in Dakota County today filed a second-degree assault charge against a 25-year-old man in connection with a gun battle on Sunday that took his mother's life.

Dakota County Attorney Kathy Keena says Billy Joe Pryor Junior also faces a charge of possession of a pistol without a permit. His conditional bail has been set at $300,000.

According to the criminal complaint, Pryor is accused of shooting his mother's ex-boyfriend in the face when Willie Selmon went to the woman's home to retrieve some of his personal belongings. Selmon later told investigators that Pryor and his mother, 49-year-old Michelle McGill, were sitting in their vehicles in the driveway when he arrived. His statement to police says he exited his vehicle after he was shot and ran to the front of McGill's vehicle because he believed Pryor would not continue shooting at him if his mother was between them.

Selmon told investigators Pryor responded by getting out of his vehicle and the two men then exchanged gunfire with the younger man's mother seated in her vehicle between them. A news release issued by the Dakota County Attorney says an autopsy determined she had suffered 10 gunshot wounds.

Keena says the deadly shooting remains under investigation and additional charges will be filed in connection with McGill's murder once it is completed. Pryor is due back in court for another hearing on July 28.
