Preston, MN (KROC AM News) - A man who was charged after being involved in a traffic crash in Fillmore County that claimed the life of an Amish teenager is scheduled for an evidentiary hearing in August.

The hearing had initially been scheduled for Monday.

The deadly accident happened last June on a rural road near Preston and claimed the life of 15-year-old Henry Hershberger of Harmony.

A pickup truck driven by 40-year-old Joseph Perry of Hastings struck the horse buggy being operated by the victim. Perry told a deputy the sun was in his eyes and he could not swerve in time to avoid the collision.

Perry was driving home at the time and had two children in the rear seat. They were not hurt.

Investigators found a small amount of marijuana and marijuana wax in Perry’s truck and he was charged with four drug-related counts. He was also charged with careless driving and driving with a suspended license.

Investigators later determined Perry was traveling at just over 50 mph at the time of the crash and did not apply his brakes.
